Question, On March 31, 2011, Scott's accidentally treated my yard with Turf Builder 2. My yard has been organic for over 20+ years and is a natural wildlife habit for almost 10 years. Scott's would like to settle with a monetary payment to correct their mistake. I have no idea how much to request for the death of my micro-organisms. What would you suggest? I've been a Howard Garrett practicer for over 20 years in Mesquite, Texas. Help!!!! Thanks for your support! Richard A. Menn |

That's a nightmare for organic gardeners, isn't it? I'd calculate the cost of all of the products you'll need to bring the yard up to full-health - zeolite, activated charcoal, molasses, nematodes, etc, (don't just take my word for it, look it up - this has been discussed in the forums before) and double it. And make them pay you for your time that it will take for all of this. If they balk at your price, you can take them to small claims court. I was just listening to an ad on the Dirt Doctor program. He recommends "turfaid" for lawns that have been previously treated by chemicals. In the zeolite/zeotech products. Good luck! |

I'm not in any position to calculate a monetary value...but since the standard award calculation in a deceptive trades practices act (dtpa) lawsuit is damages x3...that would be one formula to consider. If you are serious about the settlement matching your true costs you may want to call an attorney, Scotts has a room full of them. You very well be able to settle without counsel, but the amount you will be offered will be based on what they are willing to give you...not the amount it cost you to repair the damage. How in the world did they make that mistake? Did a neighbor hire them and they simply got the address wrong...? Or was this some kind of sales pitch? |

Those trucks have a circuit in my neighborhood, and you'll be out walking later and see those little plastic tags with a 3x5 card stating that the lawn was treated. I suspect they don't knock to see if anyone is home, so if they're not reading the order right, there you have it. I came home last year to find my front yard all marked up with stakes and spray paint - the folks who survey for various utility lines had been given the wrong address by a contractor working for a neighbor in the next block. At least they didn't start digging up my sewer line! I suppose if we had some kind of marker down at the curb that indicates this is an organic yard might just act like a magnet for the chemical pushers. Is there such a thing? A sign to let the world see that good looking yards don't need chemcials? |

Well Scotts risk management company has called me and Scotts is a least admitting that they treated my lawn when they should not have, my neighbors were the intended target. But I am still considering how many applications over what period of time it might take to reverse the effects of their 31-5-7 application they put on my 22yr organically maintained yard and Nation wildlife habitat. I have a large number of aneods,preying mantis,lady bugs, did have pupas every where,earthworms out the gazzoo, which are already hard to find and at least 30 hard backed toads that breed in my 1,000 gal goldfish pond. Which I have only seen 5 of this year. Also every native bird you can find in these parts, including a peregrin falcon. It has been 2 months now since the application and my yard is thatching faster than i can clean it off, mowed my lawn 4 times already this year and normally it would have been once so far. Anyway, I appreciated those of you who have responded and keep a close eye out when Scotts or Trugreen have a contract at your neighbors, just the run off from their yards can be a nightmare. I had a neiboor who used a industrial vaccume cleaner(the kind for parking lots),on his lawn after he used Scotts Weed and Feed and found out that on the back of the bag,it states not to be used on St. Augistine lawns.It was a site to see him doing this,Ha-Ha
